Invicta cars started life in 1925, founded by Noel Macklin and funded by Oliver Lyle of Tate & Lyle sugar with production being based from MacklinÕs home in Cobham, Surrey. The early cars were fitted with Meadows engine (Henry Meadows also known for the Rolls Royce Meteor) and found some sporting success with Violette Cordery (MacklinÕs sister in law) in long distance events as well as taking the course record at Shelsley Walsh in 1932. Production ended in 1935 as Macklin founded Railton, Invicta cars was wound up in 1938. 1946 Brought a revival of Invicta cars this time based in Virginia Water, Surrey. This brought about the Black Prince, again Meadows engines were used this time a world first for many reasons the headline features and specification include. ¥ 3 litre straight six engine ¥ Aluminium engine block ¥ Twin chain driven overhead camshafts ¥ Two spark plugs per cylinder with individual distributor and coil per cylinder ¥ Triple SU carburettors with separate Òstarting carbsÓ fitted in a specially designed inlet The Black Prince also boasted some other impressive features including a Hydraulic system designed to lift the car off the ground to aid with maintenance or to change a flat tyre, trickle charging system to run off any AC power outlet, immersion heater to keep the oil and water at temperature on frosty days. One of the first production cars with fully independent suspension, torsion bars and steering designed for Òfinger and thumbÓ driving. Only 12 Black Prince cars were built, the current owner of this vehicle is the only owners believed to have ever owned more than 1. Other known cars are a 2 door fixed head coupŽ in India, and a drophead in Australia. This is one of only 2 of the Jenson bodied cars, the other is thought to be in Paris. This particular car sports a body by Jenson in a drop head, 2 door 4 seat layout finished in Morella Maroon with off white canvass top. Owned by the current family since the 70s with only 2 previous owners both also from the North East and documented on an early brown log book. This car comes with a large history file including magazine articles, letters to and from the Invicta owners club, other owners and car fans. Residing in the current ownerÕs museum since 1992 the car will require some light commissioning, please see our walk around video for full condition details. Terms & Conditions

1. ENTRIES CLOSE

Auction entries close 24 hours before the start of the live auction unless otherwise stated or agreed

2. ENTRY FEE

An entry fee of £50 plus VAT shall be payable on all vehicles entered into any of our auctions due before auction listing

 

3. COMMISSION

In addition to the entry fee commission will be charged to the vendor and seller on each vehicle sale. Commissions are as follows

Private Seller: 5% + VAT              Trade Seller: 2.5% + VAT    

 

Buyers Fees are based on the final sale price of the vehicle and are as follows:

Under £500 - £50 + VAT              £501- £20,000 – 7.5% + VAT

£20,001 -£30,000 – 7% + VAT    £30,001 - £40,000 – 6.5% + VAT

Over £40,000 – 6% + VAT  

To qualify for Trade buyer or Trade Seller rates you must have been approved by WB & Sons ltd Management and completed the trade terms and conditions prior to bidding or entering your vehicle.

4. VAT

Whilst the sale price of any vehicle sold does not qualify for VAT auction entry fees and all buying and selling commission will be subject to VAT at the current bank of England rate.

5.PRIVATE SALES

1. No Lot entered or advertised for sale by WB & Sons ltd should be sold by the owner privately within 28 days of the auction date for which the lot has been entered or advertised. WB & Sons ltd are not under any liability for any breach of this condition.

2. In all cases where a lot is not entered for sale WB & Sons ltd shall be indemnified by the owner or person entering the lot for all expenses incurred and all third-party claims that may arise.

3. If any lot is sold privately subsequently on the sale ground (or sold privately while the vehicle remains on the sale ground) the sale must be conducted by WB & Sons ltd under standard terms and conditions of our sales and fees/commissions.

4. WB & Sons ltd reserve the right to sell privately at the reserve price any lot remaining on site after the auction date without consulting the vendor/owner.

5. If the seller later sells the vehicle as a result of any exposure in the time from entering the vehicle until it is collected from our site WB & Sons are entitled to the agreed commission should the vehicle have sold during a live auction. We reserve the right to continue to advertise a vehicle for sale after any live auction.

6 Where a lot is sold WB & Sons ltd shall initiate payment via bank transfer of the sale proceeds minus any outstanding fees or costs to the vendor within 28 days of cleared funds reaching WB & Sons from the buyer. 

7. We will only pay vendors by bank transfer; we will not send cash or cheques in any circumstance. 

6. RESERVES

Reserves shall be given in writing on the vehicle entry form before the advertised sale date. Vendors reserve the right to bid via WB & Sons as their agents and shall only bid via this method. No vendor is permitted to bid or allow anyone else to bid on their behalf on any lot entered or owned by the vendor in any circumstance. Should improper bidding be discovered WB & Sons reserve the right charge commissions on both sides on all lots entered by the vendor. 

7. VENDOR RISKS

1. All lots are accepted and remain on the sale ground at the vendor’s risk. WB & Sons ltd will not accept any liability for damage sustained to a vehicle that is attributable to members of the public or non WB & Sons ltd operatives during the sale or at any point before or after. This includes any removable items in the vehicle.

2. WB & Sons are under no liability to notify vendors if vehicles are not sold.

3. Where a vehicle is illustrated by a photograph, in the case of a vehicle registration number visible, that number will not be transferred with the vehicle to the buyer unless the registration particulars appear in the written part of the description and the transfer has been authorised by the vendor. 

4. WB & Sons ltd will keep and use any date relating to the buyer and seller in accordance with date protection legislation. The buyer and seller consent to date being kept and used for appropriate uses including matters of interest relating to WB & Sons and our partners from time to time.

5. Each vehicle is sold at the sole risk of the purchaser on the fall of the hammer during a live auction.

6. All vehicles sold by WB & Sons are collector’s items and not as a means of transport. WB & Sons ltd rely on the information given by the seller and do not provide its own description or guarantee nor do WB & Sons ltd carry out any inspections of vehicles before listing for sale. WB & Sons cannot check or verify the authenticity of any chassis or VIN number under which a vehicle is offered but relies on the seller’s description.

8. EXCLUSION OF LIABILITY

WB & Sons ltd shall not be liable for any expenses, loss, claim or proceedings in respect of any loss or damage whatsoever to any property real or personal (including all lots) whether incurred before, during or after any sale. WB & Sons ltd shall not be liable for any expense, loss, claim or proceeding in respect to any personal injury to or death of any person arising out of or in the course of or caused by the sale, except to the extent that the same is due to negligence of WB & Sons ltd, their staff or agents. 

If WB & Sons ltd receives any notification of dispute related to a sold lot before the sale proceeds have been submitted to the seller WB & Sons ltd may withhold the payment from the seller until any dispute is resolved. 

9. REMOVAL OF LOTS – Both sold and entered lots.

All lots must be cleared from the sale site within 14 days of the date of the sale unless otherwise agreed with WB & Sons ltd. If a vehicle remains after 14 days of the sale date without prior agreement WB & Sons ltd reserve the right to charge a storage and handling charge of £30 per day plus VAT until the vehicle is removed. 

A seller may by notice to the auctioneer removed a vehicle from the auction, if the seller does so they will be liable to pay WB & Sons ltd the stated rate of buyers and sellers commission calculated on the average figure of the agreed auctioneer’s guide price.  E.G if the guide price is £10,000- £12,000 the commissions shall be calculated on £11,000. 

The seller will be responsible for removing the vehicle from the sale site within 48 hours of removing from the auction. The vehicle will not be released until commissions laid out above have been paid. 

10. DESCRIPTIONS

1. The descriptions are supplied by the vendors alone who are responsible for details and accuracy. WB & Sons may make any intimation of any alterations or modification of the description of any lot immediately before asking for bids. 

2. Vendors must comply with the trade descriptions act of 1968 and be capable of substantiating all claims and descriptions of their lots. 

11. PAYMENT TO VENDORS

Vendors shall be entitled to receive the purchase price of any lot or lots sold on the 14th working day after the sale providing the auctioneer have received the same and…

1. The complaints procedure has not been invoked by or on behalf of the purchaser.

2. That in the event of any acknowledged debt of the vendor being owed to WB & Sons ltd, the latter shall have the right to offset such debt against proceeds of sale.

3. Payments shall be withheld until a valid V5 certificate or registration document is received. 

4. If the buyer fails to pay the auctioneer the total amount due within 14 days after the sale WB & Sons ltd will notify the seller and take the seller’s instruction as to the appropriate course of action. Any recovery action taken will be at the seller’s expense.

5. If circumstances out of WB & sons ltd control do not permit taking instructions from the seller, the seller hereby authorises WB & Sons ltd to at the sellers expense to agree special terms for payment of the total amount due, to remove, store and insure the lot sold.  

12. GENERAL CONDITIONS

1. WB & Sons ltd have the right to refuse an auction entry or bids at its sole discretion from any person without reason.

2. Any lot that fails to meet its agreed reserve WB & Sons may be subject to a reduced offer. If the seller accepts this offer all standard auction terms and conditions and fees apply. 

3. WB & Sons ltd reserve the right to charge an interest rate of 3% per month to any amounts outstanding over a 28-day period. 

4. These conditions shall be governed by and construed in accordance with English law. All transactions to which these conditions apply, and all matters connected therewith shall also be governed by English law. Each of the WB & Sons ltd, the seller and the buyer and any bidder hereby submits to non-exclusive jurisdiction of the courts of England and wales. 

5. The seller shall indemnify WB & Sons, its staff and agents against all payments costs and expenses incurred in respect of any breach of these terms. 

6. The seller shall maintain their insurance of the lot until they are in receipt of the sale proceeds.
