1. INTRODUCTION
The following informative notes are intended to assist Buyers of Dawsons, particularly those inexperienced or new to our saleroom or online bidding platforms. All sales are conducted according to our printed Conditions of Sale which are readily available for inspection in person, on our websites and normally accompany catalogues. Our staff will be happy to help you if there is anything you do not fully understand.
2. AGENCY
As auctioneers we usually contract as agents for the seller whose identity, for reasons of confidentiality, is not normally disclosed. Accordingly, if you buy, your primary contract is with the seller.
3. ESTIMATES
Estimates are designed to help buyers gauge what sort of sum might be involved for the purchase of a particular lot. The lower estimate may represent the reserve price or may be above the reserve price. Estimates do not include the Buyer’s Premium or VAT (where chargeable). Estimates are prepared some time before the sale and may be altered by announcement before the sale. They are in no sense definitive.
4. BUYER’S PREMIUM
The Conditions of Sale oblige buyers to pay a buyer’s premium of 27.5% on the hammer price of each lot purchased. In addition VAT is payable on this premium at the standard rate, presently 20%. (Buyer’s premium 33% inclusive of VAT).
5. VAT
The addition of (†) or (VAT applied on hammer price) to the lot description indicates that VAT is payable by the purchaser at the standard rate, presently 20%, on the hammer price as well as being payable on the buyer’s premium. This imposition of VAT is likely to be because the seller is registered for VAT within the European Union and is not operating the Dealers Margin Scheme or because VAT is due at 20% on importation into the UK. Lots which appear without either of the above symbols indicate that no VAT is payable on the hammer price. This is because such lots are sold using the Auctioneers’ Margin Scheme and it should be noted that the VAT included within the premium is not recoverable as input tax.
6. ARTIST’S RESALE RIGHTS / DROIT DE SUITE
Lots as indicated in the catalogue and if sold for the equivalent of €1000 or more on the day of the auction will be subject to a further percentage of the hammer price as follows: From €0 to €50,000 subject to 4% From €50,001 to €200,000 subject to 3% From €200,001 to €350,000 subject to 1% From €350,001 to €500,000 subject to 0.5% Exceeding €500,000 subject to 0.25% The Artist’s Resale Right payable will be the aggregate of the amounts payable under the above rate bands, subject to maximum royalty payable of €12,500 for any single work each time it is sold. Calculations of the artist’s resale right will be based on the pound sterling/Euro reference exchange rate quoted on the date of sale by the European Central Bank.
7. AGENTS
We are, primarily, agents for the seller. We are dependent on information provided by the seller and whilst we may inspect lots and act reasonably in taking a general view about them we are normally unable to carry out a detailed or any examination of lots in order to ascertain their condition in the way in which it would be wise for a buyer to do. Intending buyers have ample opportunity for inspection of goods and, therefore, accept responsibility for inspecting and investigating lots in which they may be interested. Please note carefully the exclusion of liability for the condition of lots contained in the Conditions of Sale. Neither the seller nor we, as the auctioneers, accept any responsibility for their condition. In particular, mechanical objects of any age are not guaranteed to be in working order. Additionally, in specified circumstances, lots mis-described because they are ‘deliberate forgeries’ may be returned and repayment made. There is a three-week time limit. (The expression ‘deliberate forgery’ is defined in our Conditions of Sale).
8. ELECTRICAL GOODS
These are sold as ‘antiques’ or ‘decorative’ items only and if bought for use must first be checked for compliance with safety regulations by a qualified electrician.
9. COLOURED GEMS
It is common practice for gemstones to be treated in order to enhance colour and clarity. Unless stated, buyers should presume coloured stones may well have been exposed to some sort of treatment.
10. EXPORT OF GOODS
Buyers intending to export goods, should ascertain
(a) whether an export licence is required and
(b) whether there is any specific prohibition on importing goods of that character because, e.g. they may contain prohibited materials such as ivory.
11. BIDDING
Bidders are required to register with us before the sale commences and lots will be invoiced to the name and address on the registration form. Photographic identification is required if you are unknown to us. Please enquire in advance about our arrangements for telephone bidding.
12. ABSENTEE BIDDING (COMMISSION BIDDING)
Absentee bids may be left with the auctioneers indicating the maximum amount to be bid excluding the buyers’ premium. They will be executed as cheaply as possible, with regard to the reserve (if any) and competing bids. If two buyers submit identical absentee bids the auctioneers may prefer the first bid received. Please enquire in advance about our arrangements for leaving absentee bids by telephone or email. Please ensure bids are left at least one hour prior to the start of the auction.
13. LIVE ONLINE BIDDING
(a) An online bidding service is offered via the-saleroom.com. In completing the bidder registration on these sites the buyer is agreeing to Dawson’s Conditions of Sale.
(b) In the case where a debit or credit card has been used to register, the buyer also agrees to authorise Dawson’s, if they so wish, to charge the debit or credit card given in part or full payment, including all fees, for items successfully purchased in the auction via the online bidding platforms.
(c) Please note that any lots purchased via the-saleroom.com, whether live bidding or absentee bidding, will be subject to an additional 4.95% commission charge + VAT at the rate imposed on the hammer price.
(d) Dawson’s offers online bidding services as a convenience to its clients, but neither Dawson’s nor the seller will be responsible to you for errors during or after the sale or failures to execute bids, either live bids or absentee bids placed on the internet or on your mobile device, including, without limitation, errors or failures caused by:
(i) any loss of connection to the auction being conducted online;
(ii) a breakdown or problems with the online bidding software or the website service provider; and/or
(iii) a breakdown or problems with any internet connection, computer, mobile device or system.
14. METHODS OF PAYMENT
Payment can be made by cash, debit and credit cards or bank transfer. For international bank transfers an administration fee of £25 is payable. Cheques are not accepted. Please note that regulation of money laundering means we are limited to receiving the equivalent of €10,000 in cash payment.
15. COLLECTION AND STORAGE
(a) Please note what the Conditions of Sale state about collection and storage. It is important that goods are paid for and collected promptly. Any delay may result in the buyer paying storage charges. All furniture and carpets must be collected within three working days following the auction. All other lots must be collected within five working days following the auction. Storage charges of £5 per lot per day + VAT will be strictly enforced thereafter.
(b) Dawson’s are able to arrange in-house postage via Royal Mail Special Delivery within the UK for small unbreakable items. For all other items, Dawsons will be happy to provide details of a local delivery company if required. These are suggestions only and are not the recommendation of Dawson’s or affiliated with Dawson’s in any way and as such Dawson’s cannot be held responsible for the individual performance of any other companies.
(1) INFORMATION FOR BUYERS AT AUCTIONS
Please make sure that you read our Terms of Sale set out on our website carefully before bidding in the auction. If your bid is successful, you will be obliged to comply with our Terms of Sale.
Please carefully note the exclusion of liability for the condition of Lots set out in the Terms of Sale at Clause 14.4.
Description and Conditions
(a) Whilst we seek to describe lots accurately, it may be impractical for us to carry out exhaustive due diligence on each lot. Prospective buyers are given ample opportunities to view and inspect before any sale and they (and any independent experts on their behalf) must satisfy themselves as to the accuracy of any description of a lot. Buyers are welcome to make an appointment to view any lots listed on an online only auction. Prospective buyers also bid on the understanding that, inevitably, representations or statements by us as to authorship, genuineness, origin, date, age, provenance, condition or estimated selling price involve matters of opinion. We undertake that any such opinion shall be honestly and reasonably held and accept liability for opinions given negligently or fraudulently. Subject to the foregoing neither we the auctioneer nor our employees or agents nor the seller accept liability for the correctness of such opinions and all conditions and warranties, whether relating to description, condition or quality of lots, express, implied or statutory, are hereby excluded.
(b) Condition Reports. Reports on the condition of any lot are offered by the Auctioneers as a statement of opinion only, and not of fact. Dawsons Auctioneers Ltd. are not liable for any errors or omissions contained therein. The buyer must satisfy themselves to the condition of any given lot prior to bidding. Dawsons will not be held responsible for any damage or defect that has not been notified to the buyer. Website illustrations are for guidance only and will not convey full information as to the actual condition of lots.
(c) Where the term (a/f) is used this refers to a lot being ‘as found’, it is used for guidance only and indicates in our opinion there is significant damage or repair to an item, the omission of this term does not indicate there is not significant damage or repair to an item and Dawsons are not liable for the omission of this term.
(d) Private treaty sales made on these premises under these Conditions are deemed to be sales by auction for the purposes of consumer legislation.
Bidding Platforms
Bidders using an independent bidding platform or service should note that the platform may impose an additional fee or charge, which will be added to the total amount payable in the event your bid is successful. Please refer to the terms and conditions on the relevant independent platform for rates.
(2) TERMS OF SALE
Both the sale of goods at our auctions and your relationship with us are governed by the Terms of Consignment (primarily applicable to sellers) the Terms of Sale (primarily applicable to bidders and buyers) and any notices displayed in the saleroom or announced by us at the auction (collectively, the “Conditions of Business”). The Terms of Consignment and Terms of Sale are available at our saleroom on request.
Please read these Terms of Sale carefully. Please note that if you register to bid and/or bid at auction this signifies that you agree to and will comply with these Terms of Sale.
Please note that these Terms of Sale relate to live broadcast auctions held at our premises only. We have separate terms for online only auctions.
“Auctioneer” |

means the level of the highest bid for a Lot accepted by the Auctioneer by the fall of the hammer;

means a person or entity you are acting on behalf of for the purposes of the purchase of the Lot(s); |

“Premium” |
means the fee that we will charge you on your purchase of a Lot to be calculated as set out in Clause 4.1.b; |

“Recorded Delivery” |
means a method of delivery pursuant to which the sender receives a confirmation that a letter has been posted and a signature is obtained from the recipient as a record that it has been delivered; |

“Reserve” |
means the minimum hammer price at which a Lot may be sold; |

“Restrictive Measures” |
means economic or financial sanctions, export controls, embargoes or any other restriction on trade under the laws of the European Union, the United Kingdom or the United States, or in the jurisdiction in which you, your Principal, or any agent acting for you does business; |

“Sale Proceeds” |
means the net amount due to the Seller; |
|

“Seller” |
means the person who consigns Lots for sale at our auctions; |
|
“Terms of Consignment” |
means the terms on which we agree with Sellers or their Agents to offer Lots for sale in our auctions as agent on their behalf; |
“Terms of Sale” |
means these terms of sale, as amended or updated from time to time; |

“Total Amount Due” |
means the Hammer Price for a Lot, the Premium, any applicable artist’s resale right royalty, any service charge or fee levied by the Independent Bidding Platform through which the successful bid was placed, any VAT due and any additional charges payable by a defaulting buyer under these Terms of Sale; |

“Trader” |
means a Seller who is acting for purposes relating to that Seller’s trade, business, craft or profession, whether acting personally or through another person acting in the trader’s name or on the trader’s behalf; |

“VAT” |
means Value Added Tax or any equivalent sales tax; and |
|
“Website” |

3.10 Any post auction sales of Lots offered at auction shall incorporate these conditions as if sold in the auction.
λ Under Artist’s Resale Right (ARR) UK art market professionals (including, but not limited to, auctioneers, art dealers and galleries) are required to collect a royalty for works of art produced by qualifying artists each time a work is resold during the artist’s lifetime and for a period up to 70 years following the artist’s death. This payment is only applicable to qualifying works of art when the hammer price reaches or exceeds £1,000. The charge is calculated on the portions of the hammer price according to the following rate bands:

The royalty charge is capped at £12,500 per artwork. All royalty charges are passed on, no handling costs or additional fees with respect to these charges will be retained by Dawsons. The ARR charge is VAT exempt. All items in this catalogue that are marked with † are potentially qualifying items. The charge will be added to the buyer’s invoice and must be paid before items can be released to the buyer.
8.5.1 you are in breach of your warranties in Clause 6; or
8.5.2 we have not completed our enquiries pursuant to the Money Laundering Legislation to our satisfaction; or
8.5.3 we have reason to believe that the transaction might be unlawful for any reason, or that the sale might put us under any civil or criminal liability.
Although we take reasonable precautions regarding health and safety, you are on our premises at your own risk. Please note the lay-out of the premises and security arrangements. Neither we nor our employees or agents are responsible for the safety of you or your property when you visit our premises, unless you suffer any injury to your person or damage to your property as a result of our, our employees’ or our agents’ negligence.

means the total of the Hammer Price, Premium and any applicable VAT; |

“Principal” |
means a person or entity you are acting on behalf of for the purposes of the consignment of the Goods to the Auctioneer; |

“Proceeds” |
means the Price less the Commission, the Premium, any expenses incurred to your account and any applicable VAT; |
|
“Reserve” |
means the minimum price at which the Goods may be sold; |

“Restrictive Measures” |
means economic or financial sanctions, export controls, embargoes or any other restriction on trade under the laws of the European Union, the United Kingdom or the United States, or in the jurisdiction in which you, your Principal, or any agent acting for you does business; |

“Seller” |
means the owner of the Goods and any agent who consigns the Goods for sale on the owner’s behalf (if applicable); |
|
“Terms of Consignment” |
means these terms of consignment; |

“Terms of Sale” |
means the terms of sale for bidders or buyers at our auctions; |

“Trader” |
means a Seller who is acting for purposes relating to that Seller’s trade, business, craft or profession, whether acting personally or through another person acting in the trader’s name or on the trader’s behalf (such as an agent and/or the Auctioneer); |

“VAT” |
means any Value Added Tax or equivalent sales tax; |
|
“Website” |
means our website available at www.dawsonsauctions.co.uk. |
We reserve the right to photograph all Goods unless you specifically request us in writing not to. The copyright in such photographs will be owned by us, along with the text and layout of the online digital auction catalogue.
Goods will normally be offered subject to a Reserve agreed between you and us before the auction in accordance with Clause 9. We may sell Goods below the Reserve provided that we account to you for the same sale proceeds as you would have received had the Reserve been the Hammer Price. If you specifically give us a “discretion”, we may accept a bid of up to 10% below the formal reserve.
If in our opinion any of your Goods, in particular those which are soft furnishings, infringe safety regulations, we have the right not to offer these Goods for sale. You must remove such Goods at your expense. If you do not collect such Goods within seven days of our written notice to do so, we may dispose of the Goods at your expense.

12.6 You must inform us promptly, and in any event before the auction, if you find out that the warranties in this Clause 12.3 are incorrect and/or if any of the information or documentation you have provided to us relating to the Goods is incorrect or incomplete and/or if the Goods do not match the description that you provided to us or the main characteristics of the Goods set out in the auction catalogue.
12.7 Any information that you provide in relation to the Goods may form part of the contract between both of us and the Buyer and you acknowledge that the Buyer may have a statutory right to reject the Goods if the information provided is incorrect.
12.8 If we have to refund the price of any Goods to the Buyer due to the Goods being a Deliberate Forgery, you must promptly, and in any event within seven days, reimburse to us any Proceeds that we have transferred to you for those Goods following receipt of our written notice requesting you to do so.
You warrant and undertake to us and the Buyer that you are the true owner of the Goods (or are properly authorised by the true owner to sell the Goods on the owner’s behalf) and you currently have and will have the right to sell the Goods to the Buyer with good and marketable title free of any third party rights or claims at the time when ownership of the Goods is to be transferred.
You will indemnify and keep us fully indemnified against any and all liability, loss, damage, costs (including reasonable legal fees and any VAT in relation to such fees) and expenses which we may incur or suffer as a result of any breach of Clauses 12 or 13 by you, your Principal, or anyone acting on your behalf, including without limitation, if we are required to refund the price of any Goods to the Buyer as a result of your breach of these Clauses.
You agree that the Goods will be sold to the Buyer in accordance with our Terms of Sale, a copy of which will be found on the Dawsons website and is available on request from our office.
You authorise us to deduct our Commission at the stated rate and all expenses incurred on your account from the Hammer Price, plus any applicable VAT. You consent to our right to charge the Buyer and retain beneficially the Premium plus any applicable VAT paid by the Buyer in accordance with our Terms of Sale and any interest earned on the sale proceeds until the date of settlement. You also authorise us to charge the Buyer any fee owed to an independent bidding platform or service which has been used by the Buyer when bidding for your Lot, and to pay such fee to the independent bidding platform or service.
17.1 Provided that the Buyer has paid for the Goods and we are satisfied with the outcome of our checks under the Money Laundering Legislation, we will usually pay the net sum due to you within thirty days of the last day of the auction by bank transfer.
17.2 If the Buyer has not paid for the Goods, we will not submit payment to you. In this case no settlement will be made. We will however discuss with you the rights that we may exercise under Clause 11 of our Terms of Sale in relation to a Buyer’s failure to pay. We will not release the Goods to the Buyer until we have received payment in full of the Price for the Goods and have completed necessary checks under the Money Laundering Legislation.
17.3 You must notify us in writing if your bank account details change. We will not be responsible for any payments made to the incorrect bank account if this is because you have not provided us with the correct bank account details.
17.4 If we make payments to your bank account in error, we may request reimbursement by sending you an invoice.
17.5 We may deduct any sums that you owe to us from the Proceeds.

(4) ONLINE ONLY TIMED AUCTIONS
4.1 These following terms are applicable only to sales conducted online only, where the goods have not been made available to view and are to be used in addition to the conditions of sale.
4.1.1. Right to Cancel. If you are a consumer resident in the UK you have the right to cancel the contract for the purchase of a lot within 14 calendar days without giving any reason.
iii. If you cancel the contract, we will reimburse all payments received from you. As Dawson’s are unable to provide a postage or packing service, the cost of the initial delivery or collection is not returnable. In addition the cost of returning the item if you choose to cancel the contract is payable by you.
(i). 14 calendar days after the day we receive back from you any goods supplied, or
(ii). (if earlier) 14 calendar days after the day you provide evidence that you have returned the goods. iii. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earliest.
4.2. Liability. Dawson’s nor the seller will be responsible to you for errors during or after the online only timed auction or failures to execute bids placed on the internet or on your mobile device, including, without limitation, errors or failures caused by:

GENERAL REQUIREMENTS
POSTING AND INSURANCE
VALUATION APPRAISAL
Once received your items will be filmed being unpacked, checked and/or tested by our valuation experts to ascertain their value. Any such recording may be relied upon by Dawsons Auctioneers Ltd. in the event of any dispute. This process may involve placing certain acids on the gold, silver, platinum, palladium or other items which can leave permanent staining and/or deep scratches. By submitting your items, you are in acceptance of these terms.
Dawsons Auctioneers Ltd. will not be liable for any damage caused in this way or any resulting decrease in the value of the items.
We will provide you with a valuation for sale at auction via email and the recommended date(s) for sale.
Should we be unsuccessful in contacting you after 28 days the item(s) will be subject to our standard terms of consignment and storage charges may apply. We reserve the right to consign your item(s) to auction after a period of 90 days and hold the proceeds after deduction of auction costs and any appropriate charges in accordance with our terms and conditions of sale.
UNDELIVERED RETURNED ITEMS
If the Royal Mail are unable to deliver or obtain a signature, an instruction card will be left, and packages return to the local delivery office to be collected within a certain period of time. If unclaimed within the time given the item/s will be returned to ourselves. We will then endeavour to make contact to arrange for them to be consigned to auction which will incur an administrative charge of £20 to cover all costs.
We reserve the right to consign your item(s) to auction after a period of 90 days and hold the proceeds after deduction of auction costs and any appropriate charges in accordance with our terms and conditions of sale.
LOSS LIABILITIES AND CLAIMS
We reserve the right to reject receipt of any parcel which looks as if it has been tampered with in transit to us.
It is your responsibility to obtain proof of sending and retain tracking information for insurance purposes when sending your items with our pre-paid Royal Mail service. If you do not retain this information, you may be unable to bring a claim for a lost or damaged item.
In the event of a lost or damaged parcel, in calculating value the courier service may require you to provide comprehensive evidence and proof of the value of the goods enclosed, this includes but is not limited to photographs, written valuations, weights and purchase receipts.
We do not assume any responsibility for loss or damaged parcels which occurs in transit to us when you send goods to us using The Royal Mail Special Delivery services. Any claim will be brought against Royal Mail and not Dawsons Auctioneers Ltd.
All phone calls between Dawsons Auctioneers Ltd. and its customers or potential customers may be recorded for security and training purposes. Any such recording may be relied upon by Dawsons Auctions Ltd. in the event of any dispute.
UNIDENTIFIABLE PACKS
If our application form has not been correctly complete, we are unlikely to be able to identify the owner unless a name and address is visible on the envelope. It is possible we may be able to trace it back from our website however, if this is not the case the items will be deemed as LOST PROPERTY and will be securely held by us for a period of 90 days.
To reclaim unidentified items, the customer will need to provide a full detailed description and proof of identity. Consignment to auction or return of the items will be subject to a deduction to cover storage, insurance and administration costs.
We reserve the right to consign your item(s) to auction after a period of 90 days and hold the proceeds after deduction of auction costs and any appropriate charges in accordance with our terms and conditions of sale.
LEGAL INFORMATION
This Agreement shall be governed by the laws of England and Wales. Dawsons Auctioneers Ltd.’s failure to exercise or enforce any right or provision of these Terms and Conditions will not be deemed to be a waiver of such right or provision. If any provision is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court shall endeavour to give effect to the parties’ intentions as reflected in the provision and the other provisions of these Terms and Conditions will remain in full force and effect. Customers agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the services offered by Dawsons Auctioneers Ltd. must be filed within six months after such claim or cause of action arose. Any such claim or cause of action must be filed in the UK. You agree to indemnify and hold harmless Dawsons Auctioneers Ltd. against any and all liability, claims, suits, losses, costs and legal fees caused by, arising out of, or resulting from any breach or claimed breach by you of these Terms and Conditions including claims brought by third parties.

1. INTRODUCTION
The following informative notes are intended to assist Buyers of Dawsons, particularly those inexperienced or new to our saleroom or online bidding platforms. All sales are conducted according to our printed Conditions of Sale which are readily available for inspection in person, on our websites and normally accompany catalogues. Our staff will be happy to help you if there is anything you do not fully understand.
2. AGENCY
As auctioneers we usually contract as agents for the seller whose identity, for reasons of confidentiality, is not normally disclosed. Accordingly, if you buy, your primary contract is with the seller.
3. ESTIMATES
Estimates are designed to help buyers gauge what sort of sum might be involved for the purchase of a particular lot. The lower estimate may represent the reserve price or may be above the reserve price. Estimates do not include the Buyer’s Premium or VAT (where chargeable). Estimates are prepared some time before the sale and may be altered by announcement before the sale. They are in no sense definitive.
4. BUYER’S PREMIUM
The Conditions of Sale oblige buyers to pay a buyer’s premium of 27.5% on the hammer price of each lot purchased. In addition VAT is payable on this premium at the standard rate, presently 20%. (Buyer’s premium 33% inclusive of VAT).
5. VAT
The addition of (†) or (VAT applied on hammer price) to the lot description indicates that VAT is payable by the purchaser at the standard rate, presently 20%, on the hammer price as well as being payable on the buyer’s premium. This imposition of VAT is likely to be because the seller is registered for VAT within the European Union and is not operating the Dealers Margin Scheme or because VAT is due at 20% on importation into the UK. Lots which appear without either of the above symbols indicate that no VAT is payable on the hammer price. This is because such lots are sold using the Auctioneers’ Margin Scheme and it should be noted that the VAT included within the premium is not recoverable as input tax.
6. ARTIST’S RESALE RIGHTS / DROIT DE SUITE
Lots as indicated in the catalogue and if sold for the equivalent of €1000 or more on the day of the auction will be subject to a further percentage of the hammer price as follows: From €0 to €50,000 subject to 4% From €50,001 to €200,000 subject to 3% From €200,001 to €350,000 subject to 1% From €350,001 to €500,000 subject to 0.5% Exceeding €500,000 subject to 0.25% The Artist’s Resale Right payable will be the aggregate of the amounts payable under the above rate bands, subject to maximum royalty payable of €12,500 for any single work each time it is sold. Calculations of the artist’s resale right will be based on the pound sterling/Euro reference exchange rate quoted on the date of sale by the European Central Bank.
7. AGENTS
We are, primarily, agents for the seller. We are dependent on information provided by the seller and whilst we may inspect lots and act reasonably in taking a general view about them we are normally unable to carry out a detailed or any examination of lots in order to ascertain their condition in the way in which it would be wise for a buyer to do. Intending buyers have ample opportunity for inspection of goods and, therefore, accept responsibility for inspecting and investigating lots in which they may be interested. Please note carefully the exclusion of liability for the condition of lots contained in the Conditions of Sale. Neither the seller nor we, as the auctioneers, accept any responsibility for their condition. In particular, mechanical objects of any age are not guaranteed to be in working order. Additionally, in specified circumstances, lots mis-described because they are ‘deliberate forgeries’ may be returned and repayment made. There is a three-week time limit. (The expression ‘deliberate forgery’ is defined in our Conditions of Sale).
8. ELECTRICAL GOODS
These are sold as ‘antiques’ or ‘decorative’ items only and if bought for use must first be checked for compliance with safety regulations by a qualified electrician.
9. COLOURED GEMS
It is common practice for gemstones to be treated in order to enhance colour and clarity. Unless stated, buyers should presume coloured stones may well have been exposed to some sort of treatment.
10. EXPORT OF GOODS
Buyers intending to export goods, should ascertain
(a) whether an export licence is required and
(b) whether there is any specific prohibition on importing goods of that character because, e.g. they may contain prohibited materials such as ivory.
11. BIDDING
Bidders are required to register with us before the sale commences and lots will be invoiced to the name and address on the registration form. Photographic identification is required if you are unknown to us. Please enquire in advance about our arrangements for telephone bidding.
12. ABSENTEE BIDDING (COMMISSION BIDDING)
Absentee bids may be left with the auctioneers indicating the maximum amount to be bid excluding the buyers’ premium. They will be executed as cheaply as possible, with regard to the reserve (if any) and competing bids. If two buyers submit identical absentee bids the auctioneers may prefer the first bid received. Please enquire in advance about our arrangements for leaving absentee bids by telephone or email. Please ensure bids are left at least one hour prior to the start of the auction.
13. LIVE ONLINE BIDDING
(a) An online bidding service is offered via the-saleroom.com. In completing the bidder registration on these sites the buyer is agreeing to Dawson’s Conditions of Sale.
(b) In the case where a debit or credit card has been used to register, the buyer also agrees to authorise Dawson’s, if they so wish, to charge the debit or credit card given in part or full payment, including all fees, for items successfully purchased in the auction via the online bidding platforms.
(c) Please note that any lots purchased via the-saleroom.com, whether live bidding or absentee bidding, will be subject to an additional 4.95% commission charge + VAT at the rate imposed on the hammer price.
(d) Dawson’s offers online bidding services as a convenience to its clients, but neither Dawson’s nor the seller will be responsible to you for errors during or after the sale or failures to execute bids, either live bids or absentee bids placed on the internet or on your mobile device, including, without limitation, errors or failures caused by:
(i) any loss of connection to the auction being conducted online;
(ii) a breakdown or problems with the online bidding software or the website service provider; and/or
(iii) a breakdown or problems with any internet connection, computer, mobile device or system.
14. METHODS OF PAYMENT
Payment can be made by cash, debit and credit cards or bank transfer. For international bank transfers an administration fee of £25 is payable. Cheques are not accepted. Please note that regulation of money laundering means we are limited to receiving the equivalent of €10,000 in cash payment.
15. COLLECTION AND STORAGE
(a) Please note what the Conditions of Sale state about collection and storage. It is important that goods are paid for and collected promptly. Any delay may result in the buyer paying storage charges. All furniture and carpets must be collected within three working days following the auction. All other lots must be collected within five working days following the auction. Storage charges of £5 per lot per day + VAT will be strictly enforced thereafter.
(b) Dawson’s are able to arrange in-house postage via Royal Mail Special Delivery within the UK for small unbreakable items. For all other items, Dawsons will be happy to provide details of a local delivery company if required. These are suggestions only and are not the recommendation of Dawson’s or affiliated with Dawson’s in any way and as such Dawson’s cannot be held responsible for the individual performance of any other companies.

Description and Conditions
(a) Whilst we seek to describe lots accurately, it may be impractical for us to carry out exhaustive due diligence on each lot. Prospective buyers are given ample opportunities to view and inspect before any sale and they (and any independent experts on their behalf) must satisfy themselves as to the accuracy of any description of a lot. Buyers are welcome to make an appointment to view any lots listed on an online only auction. Prospective buyers also bid on the understanding that, inevitably, representations or statements by us as to authorship, genuineness, origin, date, age, provenance, condition or estimated selling price involve matters of opinion. We undertake that any such opinion shall be honestly and reasonably held and accept liability for opinions given negligently or fraudulently. Subject to the foregoing neither we the auctioneer nor our employees or agents nor the seller accept liability for the correctness of such opinions and all conditions and warranties, whether relating to description, condition or quality of lots, express, implied or statutory, are hereby excluded.
(b) Condition Reports. Reports on the condition of any lot are offered by the Auctioneers as a statement of opinion only, and not of fact. Dawsons Auctioneers Ltd. are not liable for any errors or omissions contained therein. The buyer must satisfy themselves to the condition of any given lot prior to bidding. Dawsons will not be held responsible for any damage or defect that has not been notified to the buyer. Website illustrations are for guidance only and will not convey full information as to the actual condition of lots.
(c) Where the term (a/f) is used this refers to a lot being ‘as found’, it is used for guidance only and indicates in our opinion there is significant damage or repair to an item, the omission of this term does not indicate there is not significant damage or repair to an item and Dawsons are not liable for the omission of this term.
(d) Private treaty sales made on these premises under these Conditions are deemed to be sales by auction for the purposes of consumer legislation.

Bidders using an independent bidding platform or service should note that the platform may impose an additional fee or charge, which will be added to the total amount payable in the event your bid is successful. Please refer to the terms and conditions on the relevant independent platform for rates.

means a Seller who is acting for purposes relating to that Seller’s trade, business, craft or profession, whether acting personally or through another person acting in the trader’s name or on the trader’s behalf; |

3.10 Any post auction sales of Lots offered at auction shall incorporate these conditions as if sold in the auction.
λ Under Artist’s Resale Right (ARR) UK art market professionals (including, but not limited to, auctioneers, art dealers and galleries) are required to collect a royalty for works of art produced by qualifying artists each time a work is resold during the artist’s lifetime and for a period up to 70 years following the artist’s death. This payment is only applicable to qualifying works of art when the hammer price reaches or exceeds £1,000. The charge is calculated on the portions of the hammer price according to the following rate bands:

The royalty charge is capped at £12,500 per artwork. All royalty charges are passed on, no handling costs or additional fees with respect to these charges will be retained by Dawsons. The ARR charge is VAT exempt. All items in this catalogue that are marked with † are potentially qualifying items. The charge will be added to the buyer’s invoice and must be paid before items can be released to the buyer.
8.5.1 you are in breach of your warranties in Clause 6; or
8.5.2 we have not completed our enquiries pursuant to the Money Laundering Legislation to our satisfaction; or
8.5.3 we have reason to believe that the transaction might be unlawful for any reason, or that the sale might put us under any civil or criminal liability.
Although we take reasonable precautions regarding health and safety, you are on our premises at your own risk. Please note the lay-out of the premises and security arrangements. Neither we nor our employees or agents are responsible for the safety of you or your property when you visit our premises, unless you suffer any injury to your person or damage to your property as a result of our, our employees’ or our agents’ negligence.

means a Seller who is acting for purposes relating to that Seller’s trade, business, craft or profession, whether acting personally or through another person acting in the trader’s name or on the trader’s behalf (such as an agent and/or the Auctioneer); |

We reserve the right to photograph all Goods unless you specifically request us in writing not to. The copyright in such photographs will be owned by us, along with the text and layout of the online digital auction catalogue.
Goods will normally be offered subject to a Reserve agreed between you and us before the auction in accordance with Clause 9. We may sell Goods below the Reserve provided that we account to you for the same sale proceeds as you would have received had the Reserve been the Hammer Price. If you specifically give us a “discretion”, we may accept a bid of up to 10% below the formal reserve.
If in our opinion any of your Goods, in particular those which are soft furnishings, infringe safety regulations, we have the right not to offer these Goods for sale. You must remove such Goods at your expense. If you do not collect such Goods within seven days of our written notice to do so, we may dispose of the Goods at your expense.

12.6 You must inform us promptly, and in any event before the auction, if you find out that the warranties in this Clause 12.3 are incorrect and/or if any of the information or documentation you have provided to us relating to the Goods is incorrect or incomplete and/or if the Goods do not match the description that you provided to us or the main characteristics of the Goods set out in the auction catalogue.
12.7 Any information that you provide in relation to the Goods may form part of the contract between both of us and the Buyer and you acknowledge that the Buyer may have a statutory right to reject the Goods if the information provided is incorrect.
12.8 If we have to refund the price of any Goods to the Buyer due to the Goods being a Deliberate Forgery, you must promptly, and in any event within seven days, reimburse to us any Proceeds that we have transferred to you for those Goods following receipt of our written notice requesting you to do so.
You warrant and undertake to us and the Buyer that you are the true owner of the Goods (or are properly authorised by the true owner to sell the Goods on the owner’s behalf) and you currently have and will have the right to sell the Goods to the Buyer with good and marketable title free of any third party rights or claims at the time when ownership of the Goods is to be transferred.
You will indemnify and keep us fully indemnified against any and all liability, loss, damage, costs (including reasonable legal fees and any VAT in relation to such fees) and expenses which we may incur or suffer as a result of any breach of Clauses 12 or 13 by you, your Principal, or anyone acting on your behalf, including without limitation, if we are required to refund the price of any Goods to the Buyer as a result of your breach of these Clauses.
You agree that the Goods will be sold to the Buyer in accordance with our Terms of Sale, a copy of which will be found on the Dawsons website and is available on request from our office.
You authorise us to deduct our Commission at the stated rate and all expenses incurred on your account from the Hammer Price, plus any applicable VAT. You consent to our right to charge the Buyer and retain beneficially the Premium plus any applicable VAT paid by the Buyer in accordance with our Terms of Sale and any interest earned on the sale proceeds until the date of settlement. You also authorise us to charge the Buyer any fee owed to an independent bidding platform or service which has been used by the Buyer when bidding for your Lot, and to pay such fee to the independent bidding platform or service.
17.1 Provided that the Buyer has paid for the Goods and we are satisfied with the outcome of our checks under the Money Laundering Legislation, we will usually pay the net sum due to you within thirty days of the last day of the auction by bank transfer.
17.2 If the Buyer has not paid for the Goods, we will not submit payment to you. In this case no settlement will be made. We will however discuss with you the rights that we may exercise under Clause 11 of our Terms of Sale in relation to a Buyer’s failure to pay. We will not release the Goods to the Buyer until we have received payment in full of the Price for the Goods and have completed necessary checks under the Money Laundering Legislation.
17.3 You must notify us in writing if your bank account details change. We will not be responsible for any payments made to the incorrect bank account if this is because you have not provided us with the correct bank account details.
17.4 If we make payments to your bank account in error, we may request reimbursement by sending you an invoice.
17.5 We may deduct any sums that you owe to us from the Proceeds.

(4) ONLINE ONLY TIMED AUCTIONS
4.1 These following terms are applicable only to sales conducted online only, where the goods have not been made available to view and are to be used in addition to the conditions of sale.
4.1.1. Right to Cancel. If you are a consumer resident in the UK you have the right to cancel the contract for the purchase of a lot within 14 calendar days without giving any reason.
iii. If you cancel the contract, we will reimburse all payments received from you. As Dawson’s are unable to provide a postage or packing service, the cost of the initial delivery or collection is not returnable. In addition the cost of returning the item if you choose to cancel the contract is payable by you.
(i). 14 calendar days after the day we receive back from you any goods supplied, or
(ii). (if earlier) 14 calendar days after the day you provide evidence that you have returned the goods. iii. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earliest.
4.2. Liability. Dawson’s nor the seller will be responsible to you for errors during or after the online only timed auction or failures to execute bids placed on the internet or on your mobile device, including, without limitation, errors or failures caused by:
iii. a breakdown or problems with any internet connection, computer, mobile device or system.
(5) GOODS CONSIGNED THROUGH DAWSONS PACK, SEND, SELL SERVICE
5.1 These following terms and conditions are applicable only to consignments conducted via the Dawsons Pack, Sell, Sell Service,
GENERAL REQUIREMENTS
POSTING AND INSURANCE
VALUATION APPRAISAL
Once received your items will be filmed being unpacked, checked and/or tested by our valuation experts to ascertain their value. Any such recording may be relied upon by Dawsons Auctioneers Ltd. in the event of any dispute. This process may involve placing certain acids on the gold, silver, platinum, palladium or other items which can leave permanent staining and/or deep scratches. By submitting your items, you are in acceptance of these terms.
Dawsons Auctioneers Ltd. will not be liable for any damage caused in this way or any resulting decrease in the value of the items.
We will provide you with a valuation for sale at auction via email and the recommended date(s) for sale.
Should we be unsuccessful in contacting you after 28 days the item(s) will be subject to our standard terms of consignment and storage charges may apply. We reserve the right to consign your item(s) to auction after a period of 90 days and hold the proceeds after deduction of auction costs and any appropriate charges in accordance with our terms and conditions of sale.
UNDELIVERED RETURNED ITEMS
If the Royal Mail are unable to deliver or obtain a signature, an instruction card will be left, and packages return to the local delivery office to be collected within a certain period of time. If unclaimed within the time given the item/s will be returned to ourselves. We will then endeavour to make contact to arrange for them to be consigned to auction which will incur an administrative charge of £20 to cover all costs.
We reserve the right to consign your item(s) to auction after a period of 90 days and hold the proceeds after deduction of auction costs and any appropriate charges in accordance with our terms and conditions of sale.
LOSS LIABILITIES AND CLAIMS
We reserve the right to reject receipt of any parcel which looks as if it has been tampered with in transit to us.
It is your responsibility to obtain proof of sending and retain tracking information for insurance purposes when sending your items with our pre-paid Royal Mail service. If you do not retain this information, you may be unable to bring a claim for a lost or damaged item.
In the event of a lost or damaged parcel, in calculating value the courier service may require you to provide comprehensive evidence and proof of the value of the goods enclosed, this includes but is not limited to photographs, written valuations, weights and purchase receipts.
We do not assume any responsibility for loss or damaged parcels which occurs in transit to us when you send goods to us using The Royal Mail Special Delivery services. Any claim will be brought against Royal Mail and not Dawsons Auctioneers Ltd.
All phone calls between Dawsons Auctioneers Ltd. and its customers or potential customers may be recorded for security and training purposes. Any such recording may be relied upon by Dawsons Auctions Ltd. in the event of any dispute.
UNIDENTIFIABLE PACKS
If our application form has not been correctly complete, we are unlikely to be able to identify the owner unless a name and address is visible on the envelope. It is possible we may be able to trace it back from our website however, if this is not the case the items will be deemed as LOST PROPERTY and will be securely held by us for a period of 90 days.
To reclaim unidentified items, the customer will need to provide a full detailed description and proof of identity. Consignment to auction or return of the items will be subject to a deduction to cover storage, insurance and administration costs.
We reserve the right to consign your item(s) to auction after a period of 90 days and hold the proceeds after deduction of auction costs and any appropriate charges in accordance with our terms and conditions of sale.
LEGAL INFORMATION
This Agreement shall be governed by the laws of England and Wales. Dawsons Auctioneers Ltd.’s failure to exercise or enforce any right or provision of these Terms and Conditions will not be deemed to be a waiver of such right or provision. If any provision is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court shall endeavour to give effect to the parties’ intentions as reflected in the provision and the other provisions of these Terms and Conditions will remain in full force and effect. Customers agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the services offered by Dawsons Auctioneers Ltd. must be filed within six months after such claim or cause of action arose. Any such claim or cause of action must be filed in the UK. You agree to indemnify and hold harmless Dawsons Auctioneers Ltd. against any and all liability, claims, suits, losses, costs and legal fees caused by, arising out of, or resulting from any breach or claimed breach by you of these Terms and Conditions including claims brought by third parties.
Dawsons Auctioneers Ltd. reserves the right to change these Terms and Conditions and advise you to revisit our website at www.dawsonsauctions.co.uk periodically to ensure that you are aware of our current Terms and Conditions. If a customer sends items more than once, it is your responsibility to check the Terms and Conditions on each separate occasion that you choose to send us using items to ensure you know our latest Terms and Conditions by which you agree to be bound by sending those subsequent items to us.
