WARNING!! All lots are sold “as they lie” with all faults, typographical, photographic and quantity errors, visible damage or mechanical failings regardless of if this deems the item beyond repair. The absence of any reference to the condition of a lot does not imply that the lot is free from faults, imperfections and restorations. ClearCycle Ltd will not be held responsible for any damage or defect that has not been notified to the buyer.

ClearCycle Ltd will endeavour to write accurate descriptions on all lots and the following terms may be used when describing lots.

• “Tested Working” – We have tested the item, and the basic functions are working as designed, i.e. a mixer will power on and will turn an accessory as designed, however, this is not extensive to all the mixers functions and all accessories.
• “Powers On” – We have plugged the item in, and the item has power, i.e. it is not always possible due to time restraints to test iron, steamers, printers etc.
• “Vendor Suggests” – We the auctioneer, have not tested the item but have been advised by the vendor the item is working.

Electrical faults may not always be apparent at the time of testing, therefore no guarantee or warranty is given or implied with any lot. Any description written down in the catalogue or stated at the time of sale is not guaranteed as being correct; the information is ascertained from the goods as seen and is merely for information or identification purposes only. (The catalogue may contain photographic inaccuracies or typographical errors.) The buyer must have examined the goods prior to sale and by relying on their own judgment and assure themselves as to the condition of each item. The buyer must decide whether the description is correct and bid on what they have physically viewed in person and not on what has been described or photographed. Lots are not sold as sample; the buyer shall be deemed to have inspected the lots they buy.

Neither the vendor of any lot nor ClearCycle Ltd, their servants or agents is responsible for any errors of description, imagery or for the authenticity of any lot. Nor has anybody in the employment of ClearCycle Ltd has any authority to make or give, any representation or warranty in relation to any lot. Any implied conditions or warranties are excluded. Any information given on any lot is only a matter of opinion and inevitably neither ClearCycle Ltd nor our employees, agents or vendors accept liability for the correctives of such.

Some lots sold may be used customer returns and as such buyers must check the safety of any mechanical, gas or electrical lots prior to use and if necessary, take expert advice. ClearCycle Ltd cannot take responsibility for any damage or injury because of disregard to this advice. Neither the vendor nor ClearCycle Ltd will be liable in accordance with the Health and Safety Act 1974. The Buyer shall be responsible for any injuries and /or death resulting in the removal/use of this lot(s).

A number of electrical items sold may have been previously owned and as such may become blocked by a network provider, anti-theft software or previous user. On occasion, we may be unable to identify this at the time and therefore encourage all buyers to take reasonable steps to conduct their own due diligence. We recommend using an online system such as CheckMEND before bidding.

ClearCycle Ltd sell as agents for the vendor and as such are not responsible for any default by the seller.

Any Lots Listed as “not for online resale” are not to be resold on any online medium the most common being eBay and Amazon, by completing the purchase of any lots containing this description you further agree that should you sell any of said goods via an online sales platform that we are entitled to pass on any and all details relating to the purchase including names and addresses to the vendor for any relevant action to prevent any further online sales.

Any Person who signs up to bid on any lots on sale by ClearCycle Ltd hereby agrees not to contact any clients of ClearCycle Ltd directly without prior written consent from ClearCycle Ltd.

All persons attending the auction premises do so at their own risk. Under no circumstances will the vendor, ClearCycle Ltd, their servants or agents individually or collectively be responsible for any loss or damage caused to individuals or property whatsoever.

Buyers registering for any auction must do so online. Buyers registering for the auction must ensure that their card is 3D secure, AVS matches and accounts match the card holder’s details. Any buyers found not to have this in place will be declined and any bids made will be withdrawn. ClearCycle Ltd reserves the right to decline any buyer upon registration.

All lots are sold at the discretion of ClearCycle Ltd and as such reserves the right on behalf of themselves or the vendors too.

• Set a reserve price
• To bid on behalf of a vendor, up to the vendor's reserve price
• To allow the vendor to bid up to the reserve price
• To withdraw a sale at any time
• To rearrange, consolidate or vary the order of sale
• Be obliged to disclose the reserve price of an item

Real Auction sales are not classified as consumer sales The buyer acknowledges that this is not a consumer sale for the purposes of the sales of goods act 1979 (as amended by the Sales and Supply of Goods Act 1994 and as replaced by the Consumer Rights Act 2015) and the Unfair Contract Terms Act 1977 / 1999 Regulations and the buyer shall not seek to rely upon any conditions or Warranties implied thereby or by any other legislation. All items are sold as they lie with no grading or guarantees and can include Used Items, Salvage, Raw Returns, Ex-Display, Repossessed and Seized Goods.

GENERAL TERMS AND CONDITIONS

1. AUCTION FEES

• For auctions of upholstery, furniture, and homewares: 15% Buyers Premium + VAT
  
  

• For remote sales and full load auctions: 10% Buyers Premium + VAT
  
  

2. PAYMENT TERMS

• Full payment must be received by 4:30pm the day following the auction.
  
  

• Payments are accepted online only – no phone or in-person payments.
  
  

3. COLLECTION

• Collection is required within 2–3 working days following the sale.
  
  

• Hours: 9am to 3pm, Monday to Friday (excluding Bank Holidays).
  
  

• Collections must be pre-arranged via email. Unscheduled arrivals may result in delays.
  
  

4. DELIVERY

• Delivery is available only where stated in the lot description.
  
  

• Pallet and full load collections must be arranged by the buyer.
  
  

• To arrange delivery, email trade@clearcycle.co.uk before making payment. We will respond with a delivery cost which, once agreed, will be added to your invoice.
  
  

5. STORAGE

• Storage charges: £5 per unit per day (within a lot) up to a maximum of £50 per lot per day, applied at the discretion of ClearCycle.
  
  

• Charges can be added without notice. Items resold due to non-collection will still incur storage charges.
  
  

6. FAILURE TO COLLECT

• Failure to collect or arrange delivery within 3 days of auction end may result in goods being forfeited and repetitive failure to collect may result in the buyer being banned from future auctions.
  
  

7. SITE VISITS AND LIABILITY

• All visitors must wear protective footwear and high-visibility clothing.
  
  

• Visits are at your own risk. ClearCycle Ltd accepts no liability for injury or accidents on-site.
  
  

CONDITIONS OF SALE

1. DEFINITIONS

ClearCycle Ltd, acting as auctioneer and agent for the vendor, is referred to herein as “ClearCycle” or “the Auctioneer”.

2. GENERAL CONDITIONS

1. ClearCycle strives for catalogue accuracy. Where available, images are provided. Viewings and enquiries are encouraged.
   
   

2. ClearCycle makes no warranties regarding authenticity, condition, or quality. All goods are sold as seen.
   
   

3. Statements (oral or printed) reflect opinions only, not warranties.
   
   

4. Any statutory claim must be received in writing within five days of the sale.
   
   

3. THE AUCTION

1. ClearCycle reserves the right to:
   
   

• Combine or divide lots
  
  

• Withdraw lots
  
  

• Regulate bidding or cancel the sale
  
  

2. The highest bidder becomes the buyer. In disputes, the Auctioneer has final discretion.
   
   

3. If discrepancies arise between descriptions and images, ClearCycle may withdraw the lot and cancel the sale of that item.
   
   

4. COLLECTION & DELIVERY RESPONSIBILITY

• ClearCycle is not liable for loss, damage, or unauthorised removal of goods by third-party delivery companies contracted by the buyer.
  

• Where the delivery has been arranged by ClearCycle Ltd, any loss from or damage to a consignment must be reported to us in writing within five days from the day of delivery.

• No claims for consequential loss from delayed dispatch or cancellation.
  

• Items not collected within 2–3 days of payment may be resold. Refunds (if any) will be limited to the hammer price minus applicable charges.
  
  

5. LOSS OR DAMAGE

ClearCycle is not liable for any loss or damage to goods unless due to direct employee negligence.

6. STORAGE

• Items delivered without instructions may be stored or sold at ClearCycle’s discretion.
  
  

• Charges range from £5 to £50 per lot per day (plus VAT).
  
  

• Storage charges start after the collection window ends and continue until resale or removal.
  
  

7. ELECTRICAL & GAS ITEMS

1. No warranty is given. Buyers must arrange appropriate testing before use.
   
   

2. Items may be sold with severed cables. Even if marked “powers on”, goods are sold untested.
   
   

3. Electrical/gas items may not meet current regulations and are sold for display or research purposes unless tested and certified by a qualified person.
   
   

8. INSPECTION

By bidding, the buyer confirms they have inspected the item (physically or virtually) and are satisfied with its condition.

9. PROPERTY & RISK

• Title passes only upon full payment and collection.
  
  

• The Auctioneer has a lien on any unpaid items.
  
  

• Buyers must provide full contact details upon request.
  
  

• Failure to pay may result in resale, and any losses will be charged to the original buyer.
  
  

10. REMOVAL OF GOODS

1. No goods may be removed until paid for in full.
   
   

2. Uncollected items remain at the buyer’s risk and will incur storage charges.
   
   

3. If unpaid or uncollected after seven days, the Auctioneer may resell without notice.
   
   

4. Buyers are liable for losses, resale costs, and interest at 2% above base rate on late payments.
   
   

11. PURCHASE & PRICE

1. Payment is via secure online card or bank transfer (by request for large orders).
   
   

2. Invoices (including buyer’s premium and VAT) are issued via the PayPal payment gateway within 24 hours of the sale.
   
   

3. Full payment is due by the next working day.
   
   

4. Overdue accounts may be passed to a Debt Collection Agency, with 8% annual interest and agency fees applied.
   
   

5. Compensation may also be claimed under the Late Payment of Commercial Debts (Interest) Act 1998.
   
   

6. Online bids are binding and cannot be rescinded unless there is a genuine, provable dispute. Buyers must ensure accuracy before submitting any bid.
   
   

12. RIGHT OF ADMISSION

1. ClearCycle reserves the right to refuse admission to the premises.
   
   

2. Visitors must comply with Health & Safety protocols.
   
   

3. All second-hand goods should be checked by a competent person before use.
