Buffalo Auction House – Terms for:
Definitions
1.1 "Buffalo Auction House" refers to Buffalo Auction House, including any authorised representatives.
1.2 "Registration Process" encompasses the deposit of cash or electronic payment, completion of registration forms and commission bid forms, and the provision of two forms of identification as required.
1.3 "Registration Form" is the form completed by potential bidders prior to the auction as requested.
1.4 "Buyer" is the individual making the highest accepted bid, whether by auction or private treaty.
1.5 "Seller" refers to any individual or entity offering items for sale through Buffalo Auction House.
1.6 "Hammer Price" is the highest bid accepted, including any applicable VAT.
1.7 "Lot" refers to an individual item or group of items sold at auction.
1.8 "Deposit" means the cash or electronic payment made by potential buyers upon entering the registration process, as outlined in the auction notes.
1.9 "Auction Notes" detail specific information for each auction, including date, location, deposit details, buyer’s premium, collection instructions, and any applicable VAT charges.
1.10 "Premises" refers to the location where the auction occurs or where the goods are stored.
1.11 "Buyer's Premium" is the fee applied to the hammer price of all lots, detailed in the auction notes.
1.12 "VAT" means Value Added Tax.
1.13 "Contract" refers to the agreement formed between the buyer and seller upon acceptance of the hammer price.
1.14 "Working Day" means any day Buffalo Auction House is open for business.
1.15 "Commission Bids" are proxy bids accepted up to the start of the relevant auction.
Buyer's Duties
2.1 Buyers must remove all lots by 4 PM on the final collection day as specified in the auction notes, at their own expense and risk.
2.2 Buyers indemnify Buffalo Auction House against any damage or loss caused to adjoining lots during removal.
2.3 Buyers are responsible for any injury or damage resulting from the removal of lots and shall indemnify Buffalo Auction House accordingly.
2.4 Buyers are liable for any damage to adjoining premises and must either repair such damage or cover the estimated repair costs.
2.5 Buffalo Auction House and sellers are not liable under the Health and Safety Act 1974, and buyers agree to take reasonable precautions for safety.
Basis of Auction Sales
3.1 Buffalo Auction House is not responsible for inaccuracies in descriptions beyond main characteristics (e.g., item type).
3.2 Buyers acknowledge that descriptions of items may be subjective and not guarantees of condition or origin.
3.3 Buffalo Auction House acts solely as an agent for the seller and is not liable for any issues arising from the sale.
3.4 All lots are sold "as seen," with all faults and imperfections.
3.5 Buyers should inspect lots prior to bidding and rely on their own assessments.
3.6 No warranties are offered unless specifically stated in the item description.
3.7 Buyers acknowledge that representations made prior to sale do not constitute factual guarantees beyond material characteristics.
3.8 Buyers must arrange for the necessary equipment and labor to remove lots and comply with instructions from Buffalo Auction House.
3.9 Risk assessments may be required before lot removal, and no lots will be removed without acceptance of these assessments.
3.10 Buyers acknowledge that auction sales are not consumer sales under the Consumer Rights Act 2015.
3.11 Buyers opting for delivery must report any discrepancies within 24 hours of receipt.
3.12 All goods should be checked upon collection or delivery; damages must be reported immediately.
3.13 Images are for illustrative purposes only and may not reflect the actual items accurately.
Management of the Auction
4.1 Buffalo Auction House is not obligated to disclose reserve prices.
4.2 All bidders must complete the registration form to participate and accept these terms and conditions.
4.3 Buffalo Auction House reserves the right to refuse any bid or registration without explanation.
4.4 Buffalo Auction House may withdraw any lot prior to the hammer falling.
4.5 Admission to auctions may be refused at the discretion of Buffalo Auction House.
4.6 Attendees do so at their own risk.
4.7 The contract of sale is formed once the hammer price is accepted, subject to payment clearance. Buffalo Auction House is not a party to the contract.
4.8 Disputes regarding bidding or hammer prices will be resolved by Buffalo Auction House.
4.9 Buffalo Auction House may cancel the sale without liability to the buyer or seller.
4.10 If a third party asserts superior title to a lot, Buffalo Auction House may rescind the contract and return the hammer price.
4.11 Deposits may be requested at any time before accepting bids.
4.12 Commission bids are accepted at the discretion of Buffalo Auction House.
Payment Processes
5.1 Buyers must follow the payment processes communicated by Buffalo Auction House to settle the hammer price, VAT, and buyer's premium.
5.2 Online payments must reference the lot number and auction date.
5.3 The buyer's premium will be a percentage of the hammer price, subject to VAT as detailed in the auction notes.
5.4 Hammer prices are exclusive of VAT, which will be added where applicable.
5.5 Full payment is required before any lot removal. Payments must be made in GBP as outlined in the auction notes.
5.6 Failure to make payment as specified may result in contract cancellation.
Buyers Defaulting
6.1 If a buyer fails to remove a lot, Buffalo Auction House may:
6.1.1 Re-enter the lot for public auction.
6.1.2 Move the lot to another premises.
6.1.3 Charge a daily storage fee of £20 plus VAT per lot after the collection deadline.
6.2 If a buyer defaults on their duties, Buffalo Auction House reserves the right to:
6.2.1 Cancel the contract for that and any other lots purchased.
6.2.2 Sell the lot by auction or private treaty, with deficiencies charged to the buyer.
6.2.3 Dispose of the lot at the buyer's expense.
6.2.4 Retain lots until full payment is received.
6.2.5 Reject bids from the defaulting buyer.
Risk and Title
7.1 Title to the lot passes only upon full payment of the hammer price, buyer’s premium, and associated costs.
7.2 Lots are at the buyer's risk once the hammer price is reached.
General Terms
8.1 These terms are enforceable, and buyers agree to them upon registration.
8.2 All buyers acknowledge these terms as binding.
8.3 Private treaty sales are governed by these terms.
8.4 If any provision is found invalid or unenforceable, it will be severed, and the remaining terms will continue in effect.
